1. Acceptance of Terms

By accessing or using appog.ai and the services provided by AppoG AI (“AppoG AI,” “we,” “us”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use our services.

2. Description of Services

AppoG AI provides AI-powered communication services including:

• AI voice agents that answer inbound phone calls on behalf of business clients
• AI text (SMS) agents that respond to customer inquiries via text message
• Web-based voice widgets embedded on client websites
• Related admin and analytics tools for our business clients

3. Your Interactions with Our Agents

When you interact with an AI agent operated by AppoG AI on behalf of a business, you are having a conversation that will be processed by AI. The agent may:

• Answer your questions using information the business has provided
• Collect your contact information and inquiry details
• Follow up with you via email or SMS if you provide those details and opt in
• Route your inquiry to a human at the business for further handling

The AI agent’s responses are generated by machine and should not be relied upon as authoritative advice on legal, financial, medical, or safety matters.

4. Acceptable Use

You agree not to:

• Use our services for any unlawful purpose or in violation of any applicable laws or regulations
• Attempt to gain unauthorized access to our systems, other users’ accounts, or our clients’ systems
• Interfere with, disrupt, or attempt to reverse engineer our services
• Send messages that are harassing, threatening, defamatory, or otherwise objectionable
• Use our services to send spam, unsolicited commercial messages, or any content that violates carrier rules (including CTIA guidelines and A2P 10DLC compliance requirements)
• Impersonate any person or entity
• Use automated means to access our services except as permitted by our API

5. Business Client Content

Our business clients configure their AI agents with information about their business. AppoG AI is not responsible for the accuracy of information provided by clients or for the specific responses their AI agents generate. Any disputes about products, services, pricing, or commitments described by an AI agent should be resolved directly with the business.

6. Intellectual Property

AppoG AI retains all rights to our software, models, workflow, and platform. Content our business clients configure remains their property. Content you create in interactions (e.g., questions you ask) may be used by AppoG AI and its business clients as described in our Privacy Policy.

7. SMS Terms

If you opt in to SMS communications, additional terms in our SMS Consent page apply. In particular:

• Message frequency varies
• Message and data rates may apply
• You can opt out at any time by replying STOP
• You can request help by replying HELP

8. Third-Party Services

AppoG AI’s services rely on third-party providers including but not limited to Twilio, OpenRouter, Anthropic, Google, and cloud infrastructure providers. Their availability and performance are outside our direct control.

9. Disclaimers

Services are provided “as is.” We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, or suitable for any particular purpose.

AI responses are informational only. Do not rely on responses from our AI agents for legal, medical, financial, or safety decisions. Always verify critical information directly with the business or a qualified professional.

10. Limitation of Liability

To the maximum extent permitted by law, AppoG AI and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising from your use of our services.

Our total liability for any claim relating to our services shall not exceed the greater of $100 or the amount paid by you (if any) to AppoG AI in the twelve months preceding the claim.

11. Termination

We may suspend or terminate access to our services at any time, with or without cause and with or without notice. You may stop using our services at any time. Sections 6, 8, 9, 10, and 11 survive termination.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted with an updated “Last Updated” date. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of California without regard to conflict of laws principles. Any disputes shall be resolved in the state or federal courts located in Placer County, California.
